The bruise was bad enough for the doctor to report it to Child
Protective Services, but the mom didn't think her live-in boyfriend
inflicted it. Instead, Tiffany Lacy thought a younger, smaller
son was responsible for the injury on 4-year-old Jahmaurae Allen's chest
– and that's one of the reasons she has since been convicted of felony
child endangerment in connection with Jahmaurae's subsequent death.Prosecutors
have charged her boyfriend, Jonathan Lamar Perry, 29, with murder in
the July 21, 2008, killing of the little boy. They opened Perry's trial
Monday by calling the mother to the witness stand.

In a barely audible voice, Lacy testified that she took her three
kids to a routine pediatric exam about a month before Jahmaurae died. It
was then, she said, that she learned about the bruise. When she asked
Perry about it, he said her 3-year-old son had hurt Jahmaurae, and that
was good enough for her."Because Jahmaurae said the same thing," Lacy testified. Lacy
testified that she had seen Perry hit her kids "a few times" with a
belt, but that she never saw him punch them in the stomach or shove them
up against walls. A department store clerk and Sierra College
student, Lacy has since pleaded no contest to a single count of felony
child endangerment. She is facing a probation term and a possible six
months in jail at her sentencing, which is slated for March 4. Jahmaurae's
pediatrician, Dr. Dorothy Wilborn, testified that the boy's report to
her in her June 17, 2008, examination of him that "my brother beat me
up" didn't fit with her observation of his injuries. "I called CPS and filed a suspicion of child abuse report," Wilborn testified. A
CPS worker was sent to Perry and Lacy's Oak Hollow Drive apartment
after the referral. The caseworker left a card on the apartment door,
Lacy said.The subsequent death of Jahmurae Allen set off a
massive internal assessment of CPS procedures. Evidence later emerged
that the agency's internal records on the case had been altered. Perry's
attorney, Assistant Public Defender Mickey Sampson, said in his opening
statement that his client struck the boy on the day of the death. But
Sampson said Perry had no intent to kill and that death was not a
natural and probable consequence of his striking the boy.Sacramento
County Sheriff's Detective Brian Shortz testified under questioning
from Deputy District Attorney Jeff Ritschard that he examined the
apartment after the boy's death and found droplets of apparent blood.Some of the spatterings were found in a hallway about 30 inches up from the floor. "It roughly matched Jahmaurae's size, the distance from his mouth to the ground," Shortz told the jury.The trial resumes today in front of Judge Gary S. Mullen.

A Sacramento man has been found guilty of second-degree murder in
the beating death of his girlfriend's son two and half years ago.
A Sacramento County Superior Court jury also convicted
Jonathan Lamar Perry of assault of a child resulting in the death of
4-year-old Jahmaurae Allen and child abuse of Chauncey Allen, the
victim's brother.
Sacramento County district attorney spokeswoman Shelly Orio
said Perry was taking care of two of his girlfriend's children the
morning of July 21, 2008, when the 4-year-old wet his pants and refused
to go to bed. Perry was accused of slamming the boy against a wall twice
and punching him in the stomach. The boy was knocked unconscious and
Perry called 911 for help.
Doctors at UC Davis Medical Center determined the boy had a
fractured skull and a lacerated liver. He died that night. The other
child was unhurt.
The children's mother, Tiffany Lacy, had gone to the
hospital that morning with another child who was ill, Sacramento police
detectives said.
The jury also found Perry, on another occasion, had hit the
younger Chauncey in the stomach, resulting in three fractured ribs and a
bruised adrenal gland.
Sentencing for Perry was scheduled for April 25.
