Jury selected in trial for Marion County teen slaying
Siblings Kyle Hooper, Amber Wright to stand 1 trial, 2 juries

MARION COUNTY, Fla. -
The trial for the two siblings charged in connection to the slaying of a Marion County teen will likely start on Wednesday.
Kyle Hooper, 17, and his sister, Amber Wright, 16, will be tried together in the same courtroom, but with two separate juries.
They are both accused of taking part in the murder of 15-year-old Seath Jackson, who was beaten and shot to death in 2011.
Wright, Jackson's ex-girlfriend, was in court on Tuesday as six jurors were selected for her trial. Wright's brother, Hooper, had his six jurors selected on Monday. The two separate juries will hear much of a same evidence, but on a few occasions, one jury may be asked to step outside while witnesses talk about the other defendant, according to the state attorney's office.
Authorities say Wright and a friend sent text messages to Jackson to lure him to a Summerfield home, where three other men allegedly beat, tied up and shot the teen. Arrest reports say Jackson's body was burned, and his remains were placed into paint cans and tossed into a limestone pit.
A Marion County judge sentenced one of the other five co-defendants in Seath's murder, 21-year-old Justin Soto, last week after he pleaded guilty to first-degree murder.
Still facing first-degree murder charges in addition to Hooper and Wright is 20-year-old Michael Bargo, who authorities identified as the shooter. The fifth suspect, 19-year-old Charlie Kay Ely, received a life sentence last fall.

Jurors watch detective's interview in Seath Jackson murder trial

OCALA --
The 16-year-old girl charged with murder for luring her ex-boyfriend to a Marion County home where a group of young people killed him told investigators a “weight had been lifted off her shoulders” when she finally revealed their evil plan.
Jurors watched Amber Wright's interview with Detective Rhonda Stroop after the April 17, 2011 killing of Seath Jackson.
Both Amber Wright and Kyle Hooper are accused of taking part in a plan to lure Wright’s ex-boyfriend, Seath Jackson, to a house and killing him.
Wright said she went into another room when her brother, now 17-year-old Kyle Hooper, began to hit Jackson with a piece of wood. She said Justin Soto joined in and then she heard several gunshots fired by her new boyfriend Michael Bargo.
She said she saw Jackson run outside and then get dragged back into the home.
She said she made sure a fire didn't go out that night after the teen's mutilated body was placed in a fire pit.
At the end of the interview she told Detective Stroop she knew her mother had been crying because of her arrest.
Detectives later found Bargo, who could now face the death penalty if convicted.
Wright's attorney, Junior Barrett, questioned the interview tactics.
“What effort did you make to make sure this 15-year-old understood her rights?” Barrett asked.
“I asked her if she understood,” Detective Stroop said.
“That's it?” Barrett said.
“Yes,” she responded.
“So you had her in a small room, no windows and her mom wasn't present for this interview when you read her her rights?” Barrett pointed out to the jury.
A separate jury is deciding the fate of Wright's brother, Kyle Hooper.
State attorneys planned to play his interview with detectives Monday afternoon.
The woman convicted of murder for also helping lure Jackson to the home will not testify at the trial. Charlie Ely invoked the Fifth Amendment and Judge
David Eddy said there was nothing he could do given the situation to force her to testify.

I just cannot imagine the horror that poor Seath indured that night. There just has to be a special place in Hell for evil like this.

That's what I think about. The poor boy escaped once but they dragged him back and tortured him until he was dead. They didn't stop even when he died. Evil.

OCALA, Fla. - A 17-year-old Marion County boy and his 16-year-old sister were sentenced to life in prison Wednesday about two months after they were found guilty of first-degree murder in the death and dismemberment of another teen boy.
Kyle Hooper and his sister, Amber Wright, 16, were both found guilty of taking part in the murder of Wright's ex-boyfriend, 15-year-old Seath Jackson, who was beaten and shot to death in 2011.
Hooper apologized for his actions at the hearing, but the judge called the case the single most cold and calculated murder he's ever seen in 15 years as a judge and, before that, as an attorney.
Wright was sentenced to life in prison without parole also on Wednesday.

Man charged as accessory in Seath murder case ruled incompetent

A judge ruled Wednesday that James Young Havens III is not legally competent to stand trial for allegedly helping cover up the murder of Summerfield teenager Seath Jackson and will have to undergo treatment.
Havens, 38, is charged with accessory after the fact to murder, a first-degree felony punishable by up to 30 years in prison.
He is accused of driving Michael Shane Bargo Jr., the suspected gunman in the case, to a limerock pit in Ocala to dispose of five-gallon paint buckets containing Seath Jackson's burned remains. Authorities say he also coached five teens implicated in the killing on how to sanitize the crime scene and later drove Bargo to Starke to avoid capture.
Circuit Judge David Eddy ordered that Havens attend a rehabilitative program as a condition of his bail.
Two psychologists who examined Havens determined that he was not legally competent to stand trial. Eddy determined that the case wouldn't be able to proceed because of Havens' competency.
"When I saw him, I certainly saw a need for competency restoration training," David Bortnick, one of the psychologists who examined Havens last year, said in court Wednesday.
Bortnick suggested Havens be enrolled in a program in Gainesville that also serves Marion County.
According to the Florida Rules of Criminal Procedure, a defendant is considered legally incompetent if he doesn't understand the charges against him or their possible penalties, can't comprehend the adversarial nature of legal proceedings, or doesn't have the ability to talk with his attorney or behave appropriately in court.

Bargo's trial in Seath Jackson murder postponed until August
By Vishal Persaud, Staff writer

Circuit Judge David Eddy ordered Thursday that a PET scan be performed on Michael Bargo and granted defense attorneys' motion to continue Bargo's trial — postponing the start date for another six months.
The new tentative start date is Aug. 12.
Bargo, 20, is the last of the co-defendants to be tried in the killing of 15-year-old Seath Jackson of Summerfield. Prosecutors believe Bargo was the gunman, and they are seeking the death penalty.
In court Thursday, defense attorneys Candace Hawthorne and Charles Holloman presented testimony from Robert M. Berland, a Tampa psychiatrist who evaluated Bargo and told the court that a PET scan was "critical" in the case.
"I believe he's had a psychotic disturbance for many years," Berland said, appearing via telephone conference.
Berland testified that he believes Bargo is "severely mentally ill" and is prone to bouts of delusional and paranoid thinking brought on by a severe brain injury.
The psychiatrist surmised that Bargo's condition could have been brought on by incidents of head trauma: He was hit in the head with a brick during a fight when he was 14 or 15 and fell off the roof of a house at age 12.
Berland said the PET scan was critical to determine whether Bargo has brain damage.
Prosecutors were visibly frustrated with another six-month delay.
"The state's ready today (to go to trial)," said Assistant State Attorney Amy Berndt.
Eddy determined that allowing for the PET scan actually would help avoid future delays.
The judge said his order served to avoid arguable grounds for appeal. The move would also help defense attorneys adequately prepare mitigating evidence in the penalty phase of Bargo's trial, were it to reach that phase.

#1 - 2 snips from above:
He was competent enough to: "He is accused of driving Michael Shane Bargo Jr., the suspected gunman in the case, to a limerock pit in Ocala to dispose of five-gallon paint buckets containing Seath Jackson's burned remains. Authorities say he also coached five teens implicated in the killing on how to sanitize the crime scene and later drove Bargo to Starke to avoid capture."
So I wonder where this decision comes from?:"According to the Florida Rules of Criminal Procedure, a defendant is considered legally incompetent if he doesn't understand the charges against him or their possible penalties, can't comprehend the adversarial nature of legal proceedings, or doesn't have the ability to talk with his attorney or behave appropriately in court."
He sure seemed to understand a lot right after this heinous crime. But of course I've not met him.

for the mothers of these people as well as for Seath's family. And I will never understand how a murderer can avoid murder charges because they are mentally incompetent. If they have mental issues then they are liable to do it again when set free on the unsuspecting public. Just don't get it.
