WARREN. N.Y.-- Police arrested a registered
sex offender in Warren County Monday night, who is now facing new sexual assault charges.
The Warren County Sheriff's Department said
24-year-old Andrew Benway helped a 14-year-old Vermont girl run away from home and raped her.
According to authorities, he met the teen
online and picked her up at her home. They said the pair had sex at
Benway's Queensbury home before police found the girl.


Benway is a registered level one sex offender due to a prior incident with another 14-year-old girl.

Sex offender named in federal indictment

ALBANY -- A convicted sex offender from Queensbury faces federal
charges of bringing a 14-year-old Vermont girl to his home, where he
police said he raped her.

Andrew Benway, 24, was charged with
transporting a minor in interstate commerce with the intent to engage in
criminal sexual activity. An indictment in U.S. District Court in
Albany contends the illegal conduct took place between April 8 and
May 7.

The Times Union
reported in May that police tracked the girl to Benway's house on Oak
Tree Circle after receiving information she was missing from her home in
Hartford, Vt.

Benway was charged at the time by the Warren County Sheriff's Office with second-degree rape and criminal sex act charges.

The federal indictment noted Benway is required to register as a sex
offender because in April 2009 he was convicted of sexual misconduct in
Queensbury Town Court. That incident involved a 14-year-old he met
online. He is a Level 1 sex offender, the lowest risk of three tiers of
sex offenders monitored by the state.
If convicted of his latest
charge, Benway faces up to 10 years in prison and a maximum fine of
$250,000, according to the U.S. attorney's office.

Benway was arraigned Friday and released.
