Two charged in death of 2-year-old girl
Wilson, N.C. — Two people have been charged in the death of a 2-year-old Wilson girl, police said Tuesday.

Angel Lamm Kirby, 21, and Matthew John Redance, 24, both of 3701 Ashbrook Drive, Apt. 603, are charged with first-degree murder of Alyssia Lynn Kirby.

Police said the two called 911 on Nov. 29 to report that Kirby's 2-year-old daughter was unresponsive. Kirby and Redance flagged down a Wilson officer, who escorted them to the Wilson Medical Center. The child was pronounced dead upon arrival.

An autopsy determined the girl died as a result of injuries not consistent with natural causes, police said.

After further investigation, Kirby and Redance were arrested on Monday. They were being held Tuesday in the Wilson County jail without bond.

Autopsy: Toddler died of 'non-accidental injuries'
Wilson, N.C. — A 2-year-old Wilson girl, whose mother faces a charge of first-degree murder, died of "non-accidental" injuries to her abdomen and head, according to an autopsy released Friday.

Along with Angel Lamm Kirby, her boyfriend, Matthew John Redance, both of 3701 Ashbrook Drive, Apt. 603, also faces a first-degree murder charge in the Nov. 29, 2010, death of Alyssia Lynn Kirby.

The autopsy found three new injuries on the child's abdomen, a fresh skull fracture, an older rib fracture and three older injuries in the abdomen and pelvis. Blunt force likely caused all the injuries, the autopsy concluded.

After taking Alyssia to the pediatrician earlier in the day for a rash, Kirby and Redance told investigators they found the girl with vomit in her bed, staring and refusing to stand, according to the autopsy report.

They took Alyssia to the Wilson Medical Center but didn't do CPR on the way, the report states. It goes on to say that the girl was "pale and floppy" when she arrived at the hospital, and she was pronounced dead a half-hour later.

Kirby told pediatricians on Oct. 26, 2010, that a bruise on Alyssia's abdomen was caused by her falling out of bed on a toy, according to the autopsy report. When a doctor again questioned her about abdominal bruising on Nov. 20, 2010, Kirby said she didn't know if her child had fallen, the report states.

Kirby and Redance were placed in the Wilson County jail without bond.

Fingers point two ways in murder trial


Feb. 22--Two-year-old Alyssia Kirby died from a fatal
blow to the stomach, "ripping her intestines out of its casings,"
according to the prosecution in the case.

"Her life was cut short at 2 years old," Charles Thomas, Wilson
County assistant district attorney, told jurors during opening
statements.

Those statements marked the beginning of the murder trial of Matthew
John Redance, who is charged with first-degree murder and felony child
abuse in the little girl's death.

Redance, dressed in a black suit and a bright blue shirt and tie during court proceedings, has entered a plea of not guilty.

"Alyssia died of blunt force trauma to the abdomen," said Thomas, standing in front the jury.

Thomas also mentioned a toy chest that was inside Alyssia's room.
The chest, which had a dent in it, matched the same one embedded on the
little girl's head, Thomas said.

That dent, prosecutors contend, wasn't there before Nov. 29, 2010 -- the day Alyssia died.

Angel Lynn Kirby, the child's mother, was dating and living with
Redance during that time at Thornberry Park Apartment complex, near
Airport Boulevard and Raleigh Road.

Wilson police, who arrested the couple several days after the
child's death, also charged Kirby with first-degree murder and felony
child abuse in her daughter's death.

MOTHER AND A PLEA DEAL

During the defense's opening statement, attorney Tom Sallenger told
jurors Kirby has entered in a guilty plea of accessory after the fact of
first-degree murder and aiding and abetting child abuse.

"That lady didn't go far enough in those pleas," he said, adding Kirby should have pleaded guilty to first-degree murder.

Sallenger said Alyssia suffered from a healing fractured rib two
weeks prior to the child's death. She also suffered two black eyes at
one time and had old bruising on other parts of her body.

Sallenger said the child was in her mother's care. "She didn't work."

Redance worked as a security officer at Sandoz, a pharmaceutical
company in Wilson. His schedule was typically from early in the morning
to afternoons, according to court proceedings.

Sallenger said Kirby fell in love with Redance, but there came a
point in time when he decided the relationship wasn't going to work.

"That is when she started to panic," he said.

'SHE WANTED TO PROTECT HIM'

Prosecutors allege Redance was the last person in the child's room on Nov. 29, when he put the 2-year-old down for bed.

"Alyssia never got back up," Thomas said. "She was essentially dead or dying in her own bed."

Thomas said Kirby gave misinformation to the police about what
happened that night her daughter died. But it was because she was in
love with Redance.

"She wanted to protect him," he said. But the truth would emerge -- Alyssia died at the hands of Redance, prosecutors contend.

While opening statements are heard by jurors, they are not to
consider those statements when determining the verdict in the case.

'SHE'S NOT BREATHING'

The defense claims Kirby was the last person to put the child down
for bed. Sallenger said Redance and Kirby made a trip to the convenient
store, leaving the little girl home alone for about 10 minutes.

"That mother left that child alone in her bed, bleeding out ...
dying," Sallenger told jurors. When the couple returned home, Redance
went to check on Alyssia. But something wasn't right, Sallenger said.

Alyssia was found lying in her bed with vomit in her hair, he said.

"And she's not breathing."

Sallenger said Redance made the 911 call, not Kirby.

"That man right there did not do anything to that child," he said,
pointing to his client. Sallenger then turned around and pointed his
finger in the opposite direction.

A woman, dressed in a white button up shirt and black pants, sat in a single blue leather chair near the prosecution's table.

"That lady right there did everything to that child," Sallenger continued.

It was Angel Kirby. She would be testifying several minutes later -- against Redance.

Matthew Redance's trial has started, Angel Lamm Pleaded Guilty




Matthew Redance locked Angel Lamm’s 5-year-old nephew in a dog kennel
one day when he came to their apartment for a play visit, Lamm testified
this week.

Lamm said she discovered her 5-year-old nephew, after she walked out of her bedroom. She said Redance thought it was funny.

“I got (him) out and said it wasn’t funny,” she said.

Redance, 25, is on trial in the death of Lamm’s daughter, Alyssia Kirby,
who died Nov. 29, 2010. He is charged with first-degree murder and
felony child abuse

Lamm, 23, also been charged in her daughter’s death, reportedly pleaded guilty to accessory after the fact of first-degree murder and aiding and abetting child abuse, according to her testimony.

On Thursday, Lamm’s sister, Jamie Smith, testified that her son called
her and said he wanted to go home. He didn’t feel good. Smith said he
then began to cry.

“Momma, he put me in a dog kennel,” she testified her son said.

Smith said she immediately went to get her son and also confronted Redance about the incident.

She also asked him what type of person would do that to a child, she testified.

“He said he was putting my son where he belonged,” Smith told the court.

She never left her son alone again with Redance or her sister unless someone else was present, she said.

Smith said she took care of Alyssia daily while her sister went to
school for nursing at Wilson Community College. She testified she
confronted her sister about Alyssia’s first black eye. She said Lamm
told her Alyssia had fallen asleep on a toy inside the toy box. Less than a week later, Alyssia had a second black eye. Smith
said she asked her sister again what happened. Lamm told her sister
that the doctor said Alyssia could have been bitten by a bug, she
testified.

Prosecutor Charles Thomas asked Smith if she had ever seen Redance
discipline Alyssia. She said she saw Redance point his finger at the
child and make a sound, indicating when Alyssia did something wrong.

She said she saw Redance make that gesture one day while playing with a toy.

Thomas asked her to describe what Alyssia would do after that.

“She froze, left the room and cried,” Smith testified.

When asked about bruises on Alyssia’s body and the two black eyes, Smith said she was concerned. She told her mother about it and reported it to her sister’s caseworker, Smith said.

Under questioning by Sallenger, Lamm told the court she was told that
she would be sentenced on her plea by a judge at a later date. She also
said she had prepared for her testimony on the witness stand prior to
the trial.

“I was an accessory because I lied,” Lamm told the court.

Lamm continued to repeat herself when questioned by Sallenger on why she
pleaded guilty to those charges if she didn’t know anything about the
abuse that eventually led to the death of her child.

“Because I am in fact guilty of these charges,” she said in relation to the charges to which she pleaded guilty.

She said she was telling the truth on the stand and it wasn’t about a plea deal.

“I’m doing it for justice for my daughter,” she told the court. “I am not guilty in the death of my child.”

In talking about the reported plea, Lamm said she was guilty because she didn’t check on Alyssia when she feared Redance had done something to her daughter.

“I failed her by not getting up and checking on her when I knew I should
have,” she said. “I wanted to take her place. I would take her place. I
did wrong. I regret not going in there. I never hurt my child. I could
never hurt my child.”

Lamm said the district attorney’s office didn’t tell her what to say
when she agreed to testify against Redance as a part of the plea
arrangement.

She said she let down her daughter and she’s doing the right thing now for Alyssia.

Tears streamed down her face. Her eyes were red from the emotional testimony.

“I don’t know where Alyssia would be today or in 20 years,” she said. “I
should have went in and checked on her from the very beginning. I owe
it to her by telling the truth now ... justice for my daughter. She was
hurt so bad; she died from it. I don’t know what she could have ever
been.”

Lamm said Redance killed her daughter. She wants him to go to prison.

“I loved her,” she said. “I still love her. I miss her terribly.”

But Sallenger has pointed the finger at Lamm in the early days of the
trial. Sallenger contends Lamm was the last person in the room with
Alyssia. Thomas contends Redance was the last person in the room.

The trial is expected to resume on Monday.

What a beautiful little girl. I hope both the POS mother and boyfriend get life in prison. That poor little girl suffered so much and I hope they suffer in prison.

I thought she was so very beautiful. That's why I wanted to go ahead and post her picture when I found it,

I can never get used to this.

So, the mother lied to protect her POS boyfriend. She can cry till the cows come home and will get no sympathy from me.

jury is deliberating the fate of Matthew Redance, who is charged with
first-degree murder and child abuse in the death of 2-year-old Alyssia
Kirby.

Jurors began deliberating at 11:03 a.m. They adjourned for the day
Wednesday without reaching a verdict. Deliberations are expected to
resume on Thursday.

The jury foreman issued a note to the judge just before 12:30 p.m.
Superior Court Judge Milton F. Fitch Jr. addressed that note after a
two-hour lunch break, when court resumed at 2:30 p.m.

The note, written on white sheet of paper, indicated the jurors were
deadlocked. Fitch sent them back to the jury room to further deliberate.

The trial, which began Feb. 20, has lasted nearly three weeks. The
child’s mother, Angel Kirby Lamm, reportedly pleaded guilty to accessory
after the fact of first degree murder and aiding and abetting child
abuse, according to her own testimony. Lamm and Redance were in a
relationship at the time of Alyssia’s death on Nov. 29, 2010.
