Modesto Man Accused Of Killing Infant Son
Baby Was 2 Months Old

A Modesto man was arrested in connection with the death of his 2-month-old child, police said Friday.

Abinesh Kumar is being held at the Stanislaus County Jail on one count of murder, according to a Modesto police news release.

His son died of non-accidental injuries, the autopsy showed.

After detectives conducted interviews with the family, Kumar was arrested, police said.

He has one other child, a 1-year-old boy who was taken into custody by Child Protective Services.

Neighbors said Kumar and his wife had a long history of domestic violence. Recently, the wife left the home and hadn't been seen for about one week. Kumar and his parents were taking care of the kids.

Officers and emergency responders headed out to a medical call about 1 a.m. Thursday, in the 1400 block of Kingsbury Avenue, on a report that a child was not breathing.

They found the baby unresponsive, and revival attempts were unsuccessful. The child was pronounced dead at the scene.

MODESTO — A father is accused of killing his 2-month-old baby boy.

Emergency crews were called to a Modesto home around 1 a.m. Thursday because the baby was not breathing.

Paramedics found the 2-month-old boy was not responding, and he was declared dead at the home.

Homicide detectives say the autopsy showed the baby died from non-accidental injuries.

After conducting interviews with family members, the baby’s father, Abinesh Kumar, was arrested for murder.

Kumar’s other child, a one-year-old boy, was placed in protective custody.

MODESTO -- A 30-year-old man has pleaded not guilty to a charge
of murdering his 2-month-old son last week at his north Modesto home.
Abinesh Kumar on Thursday was arrested on suspicion of murder in his son’s death.
When he appeared in court on Monday, one count of child abuse causing
death and one count of battery on a spouse were added to his charges.
Kumar pleaded not guilty to all charges and was scheduled to appear Friday in
court for a pretrial hearing, according to the Stanislaus County district attorney’s office.
He is being held at the Stanislaus County Jail. His bail was set at $2 million.
The defendant is accused of murder in the death of his son, Abinav K.,
according to a criminal complaint filed Monday at the Stanislaus County Superior Court.
Modesto police and Stanislaus County Coroner officials have not released the infant’s name.
The child abuse charge indicates Kumar is accused of assaulting his infant
son by use of force to create great bodily injury, according to the criminal complaint.
Modesto police has said emergency personnel
went to the home in the 1400 block of Kingsbury Avenue about 1 a.m.
Thursday, responding to a report of an unresponsive child. Paramedics’
efforts to revive the boy were unsuccessful, and the infant was pronounced dead at the scene.
An autopsy found the infant had died
from “nonaccidental injuries,” but an exact cause of death had not been
determined, Modesto police spokesman Lt. Rick Armendariz has said.
After the arrest, a second child, Kumar’s 1-year-old son, was placed with
Child Protective Services. Armendariz said Thursday Kumar and the
children’s mother were separated and involved in legal proceedings over child custody.
The criminal complaint indicated Kumar also is
accused of inflicting corporal injury on a woman in July 2009, resulting
in a traumatic condition. The woman is identified as Kumar’s spouse,
but it’s unclear if she is the mother of Kumar’s children.
