NIXZMARY BROWN - 7 yo (2006) - NYC NY
The monster mom convicted in the 2006 death of Nixzmary Brown will get out of prison seven years earlier after one assault charge against her was knocked down on appeal.
Nixzaliz Santiago,
33, was found guilty of manslaughter and other counts in the shocking
child abuse case that rattled the city and led to reforms in the
embattled Administration of Children's Services.
Her sentence of 40-1/3 to 43 years behind bars was longer than the 29 years imposed on her boyfriend Cesar Rodriguez, who was convicted of of manslaughter for inflicting the blow that killed the 7-year-old girl.


The main reason Santiago got more time was the judge tacked on an extra 14 years for two assault counts.
One of them was stemmed from Nixzmary being tied to a chair with a bungee cord.
Yet
the appeals court found that Santiago was not indicted for that.
Instead, the grand jury hit her with an assault rap for smacking the
girl with a ruler, a source said.
The haunting photo of cops leaving Santiago's Bedford Stuyvesant tenement with the chair became the iconic image of the high profile case.
The
abusive mother's sentence has now been reduced to 33-1/3 to 36 years
behind bars, but the court dismissed her other appeal arguments.
"The defendant's remaining contentions are without merit," the court ruled.
The District Attorney's office and Santiago's lawyer declined comment on the decision.
