Unnamed child - 10 Months/ Accused: Diego Burgos - Greenfield / Salinas CA

SALINAS,
Calif. - The Monterey County District Attorney's office is charging
Diego Burgos for murder and assault on a child under 8 years old. The
DA issued the following release:

Monterey County District
Attorney Dean Flippo announced today that his office will amend the
complaint in the case of People v. Diego Burgos to add charges of murder
and assault on a child under 8 years old by means of force likely to
produce great bodily injury, resulting in the child's death.

The
defendant was arraigned on charges of felony child abuse and of assault
with force likely to produce great bodily injury on September 2, 2011,
and the 10 ˝ month old child passed away on September 5, 2011. It is
expected that the defendant will be arraigned on the Amended Complaint
on September 7, 2011 at 1:30 p.m.

The Greenfield Police Department initially
responded to the victim's residence on August 30, 2011. Chief Grebmeier
requested that the District Attorney's Office take over the
investigation. District Attorney Investigators Mark Puskaric, Maribel
Torres, and Allen Rowe conducted the investigation and arrested Mr.
Burgos.

A 19-year-old man pleaded not guilty this afternoon to charges related to
the death of a 10-month-old baby last week.Diego Burgos faces four counts of murder,
battery of a child causing death,
assault on a child producing paralysis and felony child endangerment
causing great bodily injury, said Rolando Mazariegos, a Monterey County
Deputy District attorney.
Burgos is expected to return to court Sept. 21.
Mazariegos said the crime allegedly occurred Aug. 26. The District Attorney’s
Office said it elevated the initial charges of felony child abuse and of
assault with force likely to produce great bodily injury after the baby died Sept. 5.
