Search of home will last well into Sunday

The search of a Hardwood Hills home in relation to a homicide investigation will continue throughout the weekend.

Sgt. Brigdit Leger, RCMP spokesperson, says officers will remain on the scene for at least another day.

"We're expecting them to remain on the scene throughout the day, into the evening and well into Sunday," Leger said.

She also confirmed that two vehicles seized this week in relation to the Amber Kirwan homicide investigation - a 2002 gray Chevrolet Impala and a 2008 blue Hyundai Elantra - are still in police custody.

"We still have both those vehicles in police custody and we're still processing them for evidence," she said.

No arrests have yet been made in relation to the case.

RCMP continue investigation
November 13, 2011

The search of a Hardwood Hills home in relation to the Amber Kirwan homicide investigation will continue throughout the day and into Monday, says Sgt. Brigdit Leger, RCMP spokesperson.

She also confirmed that two vehicles seized this week in relation to the investigation - a 2002 gray Chevrolet Impala and a 2008 blue Hyundai Elantra - are still in police custody.

She said they want to make sure that every lead is followed up to the fullest extent.

Police finish search of property in murder investigation
November 14, 2011

HARDWOOD HILL – Police have finished their search of a residence in Hardwood Hill in connection with the homicide investigation of Amber Kirwan.

Brigdit Leger, a spokeswoman for the RCMP, said police concluded their search of the residence around 7 p.m. Sunday and evidence was gathered that would assist them in their investigation of Kirwan’s death.

She also added that two vehicles seized in connection with the homicide of the 19-year-old girl are also being processed. Leger added that police are still pursuing a number of tips in conjunction with the investigation.

Police recover evidence after property search

Police say evidence was discovered during the search of a residence and property in connection with Amber Kirwan's murder.

RCMP Sgt. Brigdit Leger said Monday morning that the search of 976 Hardwood Hill Rd. in Heathbell, Pictou County, which started last Tuesday, wrapped up on Sunday evening. Leger would not elaborate on the evidence discovered at the site, saying only that the investigation continues.

Police also continue to examine two cars seized in the last week, said Leger. A grey 2002 Chevrolet Impala was seized last Monday while police picked up a blue 2008 Hyundai Elantra late Thursday evening.

Leger said police have made no arrests in connection with Kirwan's murder.

Police also say there is no connection between Kirwan's death and the murder of Eddie Phalen. Phalen, 44, was shot outside his Trenton home on Oct. 25. Leger said police continue to investigate Phalen's death and they ask anyone with information to come forward.

Police release vehicle seized in murder investigation
November 15, 2011

Police say evidence was found in a 2002 grey Chevrolet Impala seized in relation to the Amber Kirwan homicide investigation.

Sgt. Brigdit Leger with the RCMP said Tuesday that the vehicle has been thoroughly searched and has been released.

She declined to comment on the nature of the items found.

The car was seized on Nov. 7 and kept for a week as it was searched for forensic evidence.

A second vehicle, a 2008 blue Hyundai Elantra, is still in police custody and the search is ongoing.

“The other vehicle will remain with police and continue to be searched,” Leger said. “It will remain in police custody until it is thoroughly examined for evidence.”

The Elantra was seized last Thursday in Caribou River along Highway 6.

No arrests have been made in relation to the murder of 19-year-old Kirwan, who went missing in New Glasgow Oct. 9. Her body was found in the Heathbell area on Nov. 5.

Police have charged Alexander Falconer, a convicted killer, with first-degree murder and kidnapping in the death of Amber Kirwan seven months ago.

The announcement was made this morning by police officials in New Glasgow during a news conference. That conference still continues.

"Amber's murder was a shocking and senseless tragedy that impacted our entire community," New Glasgow Police Chief Delaney Chisholm said in a news release.

"The outpouring of support from citizens of New Glasgow and surrounding areas has been overwhelming."

Falconer was arrested Wednesday at Dorchester Institution in New Brunswick.

He is expected to appear in Pictou provincial court later this morning.

An adult female was also arrested but has since been released. Police would not release any other details about the investigation.

Kirwan, 19, was last seen in October leaving Dooley's pool hall at about 1:30 a.m. on Oct. 10

On Nov. 5, her remains were found in a wooded area, about a half-hour's drive from the pool hall.

Early on in the investigation, police focused their attention on Falconer, who was convicted of second-degree murder in the 1998 killing of a Pictou County cab driver.

Falconer was out of prison on full parole at the time of Kirwan’s disappearance.

On Nov. 9, he was picked up by New Glasgow police and was found carrying a switchblade and bullets. They also found three joints.

In January, he pleaded guilty to charges of possession of a prohibited weapon and possession of marijuana and returned to prison to continue serving a life sentence.

When Falconer was picked up in November, police were busy conducting an extensive search of a mobile home and property on Hardwood Hill Road in Heathbell in connection with the murder of Kirwan. The trailer had been rented by Falconer’s step-sister.

Early Wednesday evening, Taylor Hayman learned that two arrests had been made in the murder of her friend.

“She’s still gone,” said the 19-year-old. “Nothing can take the pain away.”

Hayman was supposed to go out with Kirwan, also 19, to Dooly’s pool hall the night the New Glasgow teen went missing, but she was prevented by work commitments.

Hayman joined what would become a huge community effort to find Kirwan immediately after her disappearance during the early morning hours of Oct. 10.

Wednesday night, Hayman, along with all of New Glasgow, was waiting for word on who was arrested.

All police would say is that they have arrested two adults in the murder of Kirwan, whose body was found in November on a wooded property about a half-hour drive from where she was last seen.

“We are not releasing the age, the sex, or the location of where the arrests happened at this time,” RCMP Sgt. Brigdit Leger said Wednesday.

Within days of Kirwan’s disappearance, a massive community campaign was launched to find the teenager who had hoped to go to nursing school. She was working part time at Proudfoot’s Home Hardware while attending community college.

More than 70,000 posters bearing her smile were plastered over northern Nova Scotia and dispatched around North America.

The day she went missing, Kirwan left the pool hall at about 1:30 a.m. Her boyfriend, Mason Campbell, who she’d been living with in Pictou Landing, said that she never showed up to meet him at Big Al’s Convenience Store, less than a five-minute walk from the pool hall, as they’d arranged.

Video of her walking away from Dooly’s was made public as police sought clues to her whereabouts.

Police also impounded two vehicles as part of the investigation.

Before Kirwan’s body was found, her parents, Marjorie and Donald, made a public appeal for her safe return.

On Wednesday, Marjorie Kirwan told CTV that the arrests were welcome news.

“This has been a long time coming,” she said.

Hayman was also waiting and watching.

“All we can do now is wait and hope for justice,” she said. “But it will probably take time.”

Man charged with killing Kirwan back in court
May 28, 2012


Christopher Falconer is led into the Pictou Justice Centre on May 17 where he was charged with the first degree murder of Amber Kirwan.

The man accused of kidnapping and murdering 19-year-old Amber Kirwan will be heading back to court July 27 to look at setting a date for a preliminary hearing.

Christopher Falconer appeared in court in Pictou on Monday afternoon with much less fanfare as he had only a couple of weeks earlier when he was brought in to be arraigned on charges of kidnapping and murder. There were no crowds gathered inside or outside of the justice complex and few members of the media.

Inside the courtroom, defence lawyer Mike Taylor of Halifax indicated that he was expecting at least 10 boxes of documents from the Crown to review.

Falconer was to be returned to Dorchester Penitentiary with the possibility of being move to the maximum-security prison in Renous, N.B.

Kirwan was reported missing on Oct. 9. She had been out the night before with friends at Dooly’s in New Glasgow and was supposed to meet her boyfriend Mason Campbell at a nearby convenience store. Following an intense investigation and search that involved multiple agencies and members of the public, police discovered Kirwan’s remains on Nov. 5 in a wooded lot in Heathbell.

Earlier this month, police announced Faulkner was arraigned on a first-degree murder charge that allegedly took place between Oct. 9 and Nov. 5 and a kidnapping charge that allegedly occurred on Oct. 9 at or near New Glasgow.

Falconer’s murder trial maybe year away

PICTOU — Christopher Alexander Falconer may not stand trial in the death of Amber Kirwan until next winter.

“That’s our best guess,” said Patrick Young, co-Crown counsel, outside Pictou Supreme Court on Monday.

Young spoke during a break in the first day of witness testimony in a preliminary inquiry for Falconer, 30, on charges of kidnapping and first-degree murder.

Fifteen days have been scheduled for the preliminary inquiry, the contents of which have been protected by a publication ban.

Dressed in orange prison garb, Falconer smiled as he entered the packed courtroom. He sat calmly and quietly, staring directly at the three witnesses who testified Monday.

Family and friends of Kirwan sat silently through the testimony.

Kirwan, 19, disappeared after leaving Dooly’s pool hall in New Glasgow during the early morning hours of Oct. 9, 2011. Her body was discovered in a wooded area off Heathbell Road in Pictou County on Nov. 6, 2011.

Falconer, who used to live on Heathbell Road, was picked up not long after on a parole violation. He was on parole after serving 13 years of a life sentence for killing a Pictou County cab driver at 15 years of age for a few dollars and half a pack of cigarettes.

He was charged last May in connection with Kirwan’s death.

Defence counsel Mike Taylor agreed Monday to a committal to trial, meaning he will not challenge the prosecution’s justification in seeking the criminal trial. The move should speed up the preliminary inquiry a bit, said Young.

Taylor said outside the courtroom that he did not waive the preliminary inquiry because it would allow him to gauge the Crown’s case against Falconer.

Kirwan murder trial to begin in January

PICTOU — Christopher Alexander Falconer’s first-degree murder trial in the death of Pictou County teen Amber Kirwan will begin Jan. 6.

Prosecutor Bill Gorman and defence attorney Mike Taylor requested a month for the trial during an appearance Thursday at Nova Scotia Supreme Court in Pictou.

“There’s a large number of witnesses and time-consuming evidence,” said Taylor outside the courtroom.

Taylor said his client, who was not present Thursday, will plead not guilty.

Kirwan, 19, disappeared after leaving Dooly’s pool hall in New Glasgow during the early morning hours of Oct. 9, 2011. Her body was discovered in a wooded area off Heathbell Road in Pictou County on Nov. 6, 2011.
