Woman Missing in Aruba, Was Reportedly Buried Alive Fox News

A missing Maryland woman was reportedly buried alive by her travel companion while the two were vacationing in Aruba, the National Enquirer reports.

Police received an anonymous tip that Robyn Gardner, 35, was buried in a "dog's grave," according to the paper.

Authorities have reportedly conducted a massive search in the area looking for the suspected grave.

The anonymous tipster alleges that Gardner's travel companion, Gary Giordano, beat Gardner and suffocated her, the National Enquirer reports. He then allegedly tied her arms and legs, put a bag over her head and buried her in a dog's grave, according to the report.

"He dug up a fresh dog's grave with his hands, removed the dog's body, widened the hole and put Robyn in it. He placed the dog's body on top of hers -- and covered them up," a source told the National Enquirer.

The source alleges that Gardner began moving and moaning as he filled up the grave, according to the National Enquirer.

Giordano, 50, has been behind bars since his arrest in August, three days after Gardner disappeared.

Giordano told police Gardner was swept out to sea while the two were snorkeling together.

Giordano is currently serving out a 60-day detention, which will expire Oct. 31. At that point, he'll return to court, where prosecutors will either charge him criminally or request a final detention extension for 30 more days.

Aruban prosecutors announced the ruling after a closed hearing on the Dutch Caribbean island. Gary Giordano, a 50-year-old employment agency owner from Gaithersburg, Maryland, has been in jail since Aug. 5, three days after he told police companion Robyn Gardner was swept out to sea while snorkeling.

Authorities have said they believe that the 35-year-old woman is dead and that Giordano was involved. Her body has not been found, and any evidence against Giordano has not been disclosed. He has denied any wrongdoing, while his attorneys have appealed for his immediate release.

"Our client is innocent and there has been a lot of investigation already," attorney Chris Lejuez said in an interview outside court. "There is no evidence, and his life is being destroyed."

Lejuez said that during the hearing prosecutors disclosed that a DNA test confirmed that blood found on a towel came from Gardner. But the attorney said that Giordano has maintained that she cut her toe on a rock while they were on a beach and used the towel to stop the bleeding.

A judge on the Caribbean island of Aruba has
ordered the release of a man held since August over the vanishing and
presumed death of a US woman.

Prosecutors are appealing the decision to release Gary Giordano on Tuesday and let him leave the island.

The 50-year-old says Robyn Gardner was swept out to sea while snorkelling.


But police said there were inconsistencies in Mr Giordano's
story, and it emerged he had taken out a life insurance policy on the
35-year-old.

Prosecutors, however, have no body or murder weapon.

Mr Giordano and Ms Gardner, who reportedly met on a swingers' website, are both from the US state of Maryland.

After Friday's ruling, Ms Gardner's boyfriend, Richard
Forester, also from Maryland, was quoted by the Associated Press news
agency as saying: "I'm just going to... hope the FBI has something on
[Mr Giordano]."

If he returns to the US, Mr Giordano, an employment agency owner, could still face a grand jury indictment.

Aruba judge releases US businessman Giordano despite appeal, but will the FBI arrest him if he returns to the US?'

Gary Giordano will be freed on Tuesday without conditions and could be home in Gaithersburg, Maryland by Wednesday.The 50-year-old employment agency owner has been in jail since August 5, as investigators sought more time to gather and evaluate evidence over the disappearance of 35-year-old Robyn Gardner, of Frederick, Maryland.
But he may not be entirely free.
Criminologist Casey Jordan told CBS’s The Early Show on Saturday Morning that Giordano is under continued investigation by the FBI, as well as Aruban officials. He's also in some legal hot water.

‘We assume [Giordano] is going to come back to the United States and yet, he is in trouble in a number of ways here in the U.S.,’ Miss Jordan said.
‘He has two ex-wives. He has support issues. He had filed a lawsuit here. He is in financial shambles. I think the greatest fear here is: what if he does not return to the U.S.? What if he tries to flee to another foreign country?’
The FBI did not immediately comment on the case. But Miss Jordan says that as long as Giordano remains in the U.S., ‘this is not as bad as we may think. Him coming back to the United States as long as he stays here is not so bad, we will know where he is.’



She said investigators and prosecutors can still hunt for clues, including the body of Robyn Gardner, blood evidence, additional witnesses, and other evidence that links Giordano to the crime.
‘If he goes elsewhere,’ Miss Jordan added, ‘it could be another Jordan van der Sloot story.’
Jordan van der Sloot, who is accused of killing of a Peruvian woman five years to the day after US student Natalee Holloway disappeared, fled to Chile after the woman’s death.
He was arrested there and flown back to Peru for questioning

Aruban authorities have said they believe Giordano was involved in the death, Fox News reports.
Giordano claims that Miss Gardner was swept out to sea on August 2 while snorkeling.
Prosecutors immediately filed an appeal seeking to reverse the ruling and prevent Giordano from leaving jail, Taco Stein, Aruba's solicitor general, said. A three-judge appeals panel will consider the matter.
Giardano's attorney Chris Lejuez said Giordano 'couldn't believe' the decision because he had lost faith and confidence in the Aruban criminal justice systems.
'When I asked him what he really thinks about his release, he started to cry and asked me to excuse him for a few minutes,' the attorney said.
He added that he believes Giordano would leave as soon as he is freed.

U.S. Man Suspected in Case of Missing Woman Released From Aruba Jail

ORANJESTAD, Aruba – U.S. businessman Gary Giordano has been released from jail in Aruba after nearly four months of detention as a suspect in the disappearance of his traveling companion, Robyn Gardner.

Giordano is now free to leave the Dutch Caribbean island but his immediate plans are not clear.

Prosecutors still consider him a suspect in Gardner's presumed death. He left the jail with his lawyers.

A judge allowed his pretrial detention order to expire Tuesday, ruling prosecutors failed to present enough evidence to continue holding him as a suspect in the presumed death of Robyn Gardner.

But prosecutors say they are still trying to build a case against him and will seek his extradition if an appeal's court ruling expected Wednesday issues a reversal and orders the 50-year-old businessman back to jail.

"The case does not end here. Mr. Giordano will remain our prime suspect," said Solicitor General Taco Stein.

Giordano has been a suspect since Aug. 5, three days after reporting to police that Gardner was apparently pulled out to sea while they were snorkeling off the southern tip of the island. Her body has never been found despite extensive searches, leaving investigators with only a circumstantial case that a crime was even committed.

Aruban law allows for pretrial detention while authorities investigate a crime, but it is subject to a judge's review and the threshold of evidence necessary to hold someone increases as times goes on. A judge ruled last week that prosecutors had not met the requirement and ordered release for Giordano, of Gaithersburg, Maryland.

Prosecutors have appealed but the hearing on their request is not scheduled until Wednesday.

"The investigation must have yield enough investigation to draft a charge," Stein said. "And we are not in that position yet."

The case has drawn comparison to that of Natalee Holloway, who disappeared on Aruba in May 2005 on the last night of her high school graduation trip to the island. Her body was also never found and the prime suspect was detained for months before he was eventually released for lack of evidence.

Kelly Reed, a cousin of Gardner's, said the family hopes attention to the case will generate a lead that will help investigators resolve the case.

"Needless to say, our family is very disappointed that even after all this time, we are no closer to finding out what happened to our Robyn," Reed said in a statement. "We trust that the FBI and the Aruban authorities will continue their fervent efforts to investigate her disappearance."

Giordano, the divorced owner of an employment services company, first drew suspicion with what investigators felt were inconsistencies in his account of Gardner's disappearance. Later, they learned he had taken out a $1.5 million accidental death policy on her, which Stein said was viewed as a possible motive.

Gardner's friends and family also had serious doubts about her disappearance, saying it was unlikely the 35-year-old woman from Frederick, Maryland, would have gone snorkeling in the first place.

Giordano's lawyers have said there is no evidence he committed any crime.

His American lawyer, Jose Baez, said in a statement that the defense team was grateful for the judge's ruling and that Giordano was "excited to return home to his family in the United States."

Chris Lejuez, Giordano's Aruban defense lawyer, said they were still trying to work out when he would be released Tuesday and it might not be possible for him to leave Aruba until Wednesday.

Once back in the U.S., he would be free to file a claim to redeem the American Express travel insurance policy he took out on Gardner.

An American Express spokeswoman, Gail Wasserman, said she could not confirm that Giordano has such a policy but said anyone making such a claim would have to produce documentation such as a death certificate and any police reports. "Then we would make a determination if the claim is payable."

No claim would be paid if it turned out there was fraud or "anything untoward" that would void the policy, she said.

Stein said authorities have been conducting active searches for Gardner's body and last week sent divers and underwater robots to search in the area where Giordano reported her missing. They are also awaiting additional forensic evidence, including an FBI analysis of Giordano's Blackberry.

Investigators do not believe Giordano's account of Gardner being pulled out to sea, based on weather conditions and a re-enactment.

"We know he has been lying about what happened ... We know his story is not true," Stein said.

ORANJESTAD, Aruba (AP) - A prosecutor in Aruba says he has appealed a judge's decision to set free a U.S. businessman who is suspected in the disappearance and presumed death of his traveling companion.

If the appeal is denied, Gary Giordano will have to be released from jail next week, and will be free to leave the island. He's spent nearly four months in custody as investigators look for more time to gather and evaluate evidence in the death of Robyn Gardner. She and Giordano are both from Maryland.

He maintains that Gardner was swept out to see while snorkeling in early August.

Prosecutor Taco Stein says today's decision is a "setback." He says Giordano is "still a flight risk" and that the investigation continues.

The prosecutor says investigators need more time to analyze information from his laptop and his iPad. If Giordano is set free and leaves Aruba, and a judge later finds enough evidence to order him to be rearrested, the prosecutor says he would request his extradition from the U.S.
On the "Help Find Robyn Gardner" Facebook page, a message was posted lamenting Giordano's impending release.

"Yes...it's true. Not much to say, but let's all hope and pray that the US authorities have something to charge him with here," the post reads. "We are not giving up on Robyn."

Attorneys for Giordano say that their client will be a free man by Tuesday and home in Maryland by Wednesday after over 100 days on the island. Attorneys say that he made a plea for his freedom to the judge during the hearing.

No trace of Gardner, a Bethesda resident, has been found in the past several months.

ORANJESTAD, Aruba (WUSA) - A man jailed in Aruba in relation to the disappearance of Robyn Gardner is due to be released soon but the prosecutor's office says his freedom might not last very long.

9 News Now's Scott Broom had a one-on-one interview with Aruba's top prosecutor Taco Stein, who says he's appealing the release order for Gary Giordano at an 11 a.m. hearing Wednesday.

By then, Gary Giordano may be long gone from Aruba, forcing Solicitor General Taco Stein to extradite him from whatever nation he may be able get to on an early flight Wednesday. It's not an ideal situation Stein says but it's the law in Aruba.
In anticipation of his release, on Tuesday Gardner's family issued a statement through the Natalie Holloway Center, which is assisting them in the case:

"Our family is very disappointed that even after all this time, we are no closer to finding out what happened to our Robyn, " said cousin Kelly Reed. "We trust that the FBI and the Aruban authorities will continue their fervent efforts to investigate her disappearance. "

Meanwhile, in Giordano's Gaithersburg neighborhood two neighbors were denied requests for a no-contact protective order from Giordano should he return home. The neighbors alleged Girodano had thrown trash on their property.

The question now isL will Giordano return to the U.S. or go to some other country during the window of freedom he has before Wednesday's appeals hearing?

His lawyers are not saying what their strategy will be. He's expected to walk of the prison in Aruba between 5 p.m. and 9 p.m. Tuesday.

The 50-year-old American businessman emerged from the KIA prison, without addressing the crowd of American and local media that had gathered outside, and got into a small SUV, driven by his Aruban attorney Chris Lejueze. His attorney Jose Baez was also in the vehicle, which the media immediately swarmed, blocking the car for a few tense moments to peer inside, before the SUV drove out of the prison gates.

Giordano will leave the island tomorrow for the United States, before the Aruban High Court convenes at 11 a.m. ET Wednesday.

The island's prosecutors have appealed Giordano's release, and the judges could decide to extend his detention another 30 days, in which case they would likely seek to have him extradited.

Taco Stein, Aruba's solicitor general, spent the day scrambling to convince the appeals panel to convene sooner than Wednesday morning.

"Whether a high court will grant a detention, we want to make it clear that for us, the case does not end here. Giordano will remain our prime suspect," Stein said at a press conference Tuesday.

Earlier on Tuesday, mere hours before Giordano was set free, Gardner's family released a statement to ABC News saying they are disappointed at the lack of answers about how she disappeared.

"Needless to say, our family is very disappointed that even after all this time, we are no closer to finding out what happened to our Robyn," Kelly Reed, Gardner's cousin, told ABC News in a statement. "We trust that the FBI and the Aruban authorities will continue their fervent efforts to investigate her disappearance."
Gardner's family also said today they are still hopeful that someone with information about Gardner's whereabouts could come forward.

"Perhaps the public attention that this has generated will result in someone stepping forward with information that will help find her," Reed said.

It's a case that is eerily similar in outcome to the disapperance of Natalee Holloway in 2005 -- another blonde American woman who vanished from the island. Jordan van der Sloot, the man suspected of killing Holloway, was released. He is now in prison in Lima, Peru, charged with the 2010 murder of a Peruvian woman. Holloway has never been found.

Giordano's release after 116 days in jail comes after an Aruban judge threw out the prosecutors' request to keep him detained without charge for an additional 30 days. Aruban prosecutors do not have a body or a murder weapon, and have not locked down a definitive motive for Giordano to kill Gardner, 35. But they have argued they have enough circumstantial evidence to keep him in an Aruban jail.

Giordano's lawyer, Jose Baez, told ABC News that his client would be willing to comply with any extradition order if needed at a later date.

"Should they decide to extradite him, Gary's not going to run from anything. Gary's not running from anything. He'll come back voluntarily. It's not going to be anything that I think is going to be a problem," Baez said.

Aruban authorities told ABC News that they would seriously consider having Giordano extradited if they discover any hard evidence against him.

Investigators told ABC News they have Giordano's laptop and Blackberry, and are just beginning to pore through the computer, as well as Gardner's iPad -- both of which contain tens of thousands of documents that shed light on the relationship the two had, which Giordano has previously said was almost entirely physical.

Baez, who gained fame this summer when he spearheaded Casey Anthony's acquittal on charges she murdered her 2-year-old daughter Caylee, called the conditions that led to Giordano's spending over 116 days in an Aruban jail disastrous.

"You throw in the circumstances of how Robyn disappeared, and you throw in the fact that Gary is an American, and it creates a recipe for disaster, one that has kept him locked up for four months, in prison, uncharged," Baez said.

Jose Baez tells HLN: Gary Giordano has a different lifestyle
Jose Baez’s defense of Gary Giordano took some unusual and provocative turns tonight on HLN’s “Issues With Jane Velez-Mitchell.”

Giordano is a suspect in the disappearance of travel companion Robyn Gardner during a trip to Aruba four months ago. Velez-Mitchell quoted Aruban police who said they found “beyond pornographic photos of Robyn on Gary’s camera.”

Baez said that photos exist but questioned the term “beyond pornographic.”

“I don’t know what that means,” Baez told Velez-Mitchell. “That’s like saying I can’t describe pornography. I just know it when I see it.”

But Baez added that the photos were between two single, consulting adults and had nothing to do with Gardner’s disappearance other than “scandalizing” the case.

“It makes for juicy tabloid speculation,” Baez said. Baez wouldn’t answer Velez-Mitchell’s question about whether Giordano is a swinger.

“Gary has a different lifestyle than perhaps you and I,” Baez said. “I don’t think it’s my place to talk about what he does privately.”

Baez described the case against Giordano as “supposition upon supposition, guess upon guess. Just because she hasn’t been recovered or found, they’ve just pointed the finger to a convenient person, which has been Gary.” Baez also dismissed two women’s allegations against Giordano as the complaints of scorned lovers.

“That has absolutely nothing to do with Robyn and Gary,” Baez said. “To bring out the mud – everyone has a past, everybody’s done things that they’re not proud of. To try and bring that up as some kind of reason why he would murder a friend of his is really inappropriate.”

On “Good Morning America” Thursday morning, Giordano said he had nothing to do with Gardner’s disappearance.

Baez became a familiar TV presence when he defended Casey Anthony in her murder trial. Baez will be a guest on “Dateline NBC” at 10 p.m. Friday.

The subject: not Anthony, but Giordano.

(OP comment...I will NOT watch this live tonight...as always will wait for a later report so NO $$$...that is just me...but, if some of you do want to watch)

Baez talks to “Dateline NBC” this week about the mystery of Robyn Gardner’s disappearance in Aruba. Baez, who defended Casey Anthony, is part of suspect Gary Giordano’s legal team. Giordano has been freed from an Aruba jail.

“Dateline NBC” airs at 9:00 pm central.

NBC News said of its program: “Josh Mankiewicz and Dateline’s Unsolved Case Squad go to Aruba and do its own investigation, tracing Gardner’s steps.”
