2-year-old dies, brother in critical condition after mother left them alone in SUV

MESA COUNTY, Colo. — A 2-year-old boy died and his 4-year-old brother was in critical condition after their mother admitted to leaving them inside an SUV for 90 minutes with its engine running.

The Grand Junction Daily Sentinel reports an affidavit written by a Mesa County Sheriff’s office investigator shows she left her boys while she met a man near the Powderhorn Mountain Resort east of Grand Junction Tuesday night.

Heather Jensen, 24, called 911 saying her youngest son was unconscious and not breathing. William Jensen was pronounced dead at the scene.

His brother, Tyler, is in critical condition at Children’s Hospital in Aurora. The boys’ step-grandfather, Robert Mathena, says Tyler is improving.

“He’s starting to respond a little bit, he’s opening his eyes, looking around. I guess he has some kind of liver damage, too,” Mathena says. He believes the boys had carbon monoxide poisoning.

The boys’ mother told Mesa County Sheriff’s Office investigators she was sitting in the man’s truck next to her SUV.

She had let the boys play in the snow before putting them back in their car seats in her Toyota 4Runner.

She says she drove away and heard her 4-year-old gurgling. That’s when she stopped and realized the 2-year-old wasn’t breathing and she called 911.

The cause of William Jensen’s death has not been released. There have been no charges filed in the case so far.

The Sentinel reports this investigation comes just after the death of Heather Jensen’s husband, Eric. He was killed in a two-car crash on Oct. 10 in Garfield County.

This is a stange case. I'm interested to find out what the cause of death is because I don't understand how it could be carbon monoxide if the car was in an open area.

Abuse none the less. She left them in the vehicle 90 minutes by themselves. You don't leave a kid in a car for five minutes let alone 90.

GRAND JUNCTION - Authorities are investigating after one child died and another was injured after they were found in a car near the Powderhorn ski resort.

Investigators with the Mesa County Sheriff's Office and the coroner's office were at the scene Tuesday night trying to determine what happened.

NBC affiliate KKCO reports 2-year-old William Jensen died Tuesday inside a red Toyota 4 Runner. His 4-year-old brother, Tyler Jensen, is on life-support at Children's Hospital in Denver.

The children's step-grandfather told KKCO he believes the two suffered carbon monoxide poisoning after they were left in the running vehicle by their mother, Heather.

The Mesa County Sheriff's Office says the coroner has completed the autopsy, but they are not releasing the results because it's tied in with the investigation.

"Once the cause and manner is released, a lot more information would make sense and pieces would fall together for the public. We are not at that point though," Heather Benjamin, a spokesperson for the Mesa County Sheriff's Office, said.

The boys' father died in a car accident in Rifle last month, according to KKCO.

Autopsy Report In Child Death Investigation May Take Months

GRAND JUNCTION, Colo. (CBS4)- It could take months for an autopsy report from the Mesa County Coroner to be made public in the investigation of a child death near Powderhorn Ski Area.

The mother of a toddler who died in a car this week near a Colorado ski resort told police she left the boy and his brother alone in the SUV while it was running for an hour and a half, according to court documents obtained by a Grand Junction newspaper.

The children were found Tuesday night in a Toyota 4-Runner near the Powderhorn ski area. Tyler, 4, was taken to a hospital in Grand Junction and then airlifted to Children’s Hospital in Denver. He was listed as being in critical condition on Wednesday.

The exact nature of how Tyler was injured haven’t been released, but it’s thought carbon monoxide poisoning played a role. Autopsy results also haven’t been released so far in the death of his brother William, 2.

The Daily Sentinel reports that police records show their mother, Heather Jensen, 24, of Palisade, told a Mesa County sheriff’s investigator she was in the car of a man while the children were in the SUV alone. She was also apparently the one who called 911 to report that the boys were in trouble.

The newspaper also reported that Jensen first told police she was outside the vehicle for only 10 minutes but then changed her story.

The incident happened inside a vehicle parked on the side of Powderhorn Road, just off Highway 65 at about 6:30 p.m. Tuesday. That is near the entrance to Powderhorn Ski Resort, which isn’t open for the season yet.

Jensen posted photos of the boys on her Facebook page hours after making the 911 call, saying “I miss my boys.”

The Mesa County Sheriff’s office so far hasn’t released a report to media in the case. They are calling it only a death investigation.

The Sentinel also reported that police searched Jensen’s vehicle and that an investigator wrote in that search warrant that there was probable cause to believe a crime of child abuse resulting in death had been committed.

CBS4′s request to view the same court documents the Sentinel was provided access to was rejected.

“How is this not considered a criminal investigation if a child has died?” CBS4′s Jeff Todd asked Mesa County Sheriff’s spokeswoman Heather Benjamin.

“Well it may get to that. It just depends on the coroner’s results and where that goes into our investigation,” Benjamin said. “Child abuse cases typically aren’t black or white.”

The autopsy on William is expected to provide additional information in the case. It could take two months or longer for the autopsy report to be released.

“An illness, something like that, that wasn’t discovered or wasn’t obvious on scene, compared to comparing evidence on scene or evidence gathered through the course of the investigation that may turn it into a criminal investigation,” said Benjamin.

The newspaper also reported that Jensen’s 26-year-old husband Eric died in an accident in October.

4-year-old Palisade boy left in running SUV dies, family says

DENVER — A four-year-old Palisade boy suffering from brain damage at Children’s Hospital was taken off life support and died Monday night, the family said.

Tyler Jensen was put on life support after being left in a running car for an hour and a half last week. His two-year-old brother William, who was also in the car, died on the scene.

Some of his family members went to Grand Junction to try to gain custody of the boys from their mother, 24-year-old Heather Jensen, when it was discovered that the two had been left inside a running Toyota 4Runner for 90 minutes.

Heather told police she left her boys inside the SUV while she sat in a man’s truck that was parked next to the vehicle.

When she drove away, she told police she heard Tyler gurgling. That’s when she stopped and realized William wasn’t breathing. She called 911.

Emergency workers speculated the boys were poisoned by carbon monoxide, but friends of the family say that possibility has been ruled out.

Tyler’s step-grandfather Robert Mathena said the four-year-old had an MRI on Nov. 29 that showed he had severe liver and kidney damage. A medical expert said the gurgling sounds he made trying to breathe could be a sign of fluid in the lungs.

What got Tyler so sick is still not completely known, and the Mesa County Corner still hasn’t released a cause of William’s death.

Authorities have said they are not yet sure if they will file criminal charges against Heather.

“Tyler was a 4-year-old little boy, full of life,” Mathena, said. ”He loved fishing, hiking, playing. He was a great kid. We all love him and we’re all devastated about this.”

The death of both boys came just weeks after their father, Eric, died in a head-on collision Oct. 10.

Family, friends remember boys who died after being left alone in running vehicle

LITTLETON, Colo. — In the darkness of a park in Littleton, candles bring much needed light to a family’s darkness.

“The candles to me symbolize hope that we’ll heal,” said the boy’s aunt Tressa Norberg.

Family and friends want answers surrounding the deaths of brothers William and Tyler Mathena.

Two-year-old William was found unresponsive in a car three days after Thanksgiving near Powderhorn ski resort in Mesa County. His 4-year-old brother who was next to him, died Monday.

The boys’ mother said she left them alone in her running vehicle for 90 minutes while she was with a man in a vehicle right next to hers.

“We want to know what happened so we can move forward and honor their memories,” said Norberg.

The family says police have ruled out carbon monoxide poisoning as a cause of death leaving many questions. Their mother has not been ruled out as a suspect.

We just want answers and justice for William and Tyler. They left way too soon,” said the boys’ uncle Roger Mathena.

Judge blocks Jensen cremations

Mesa County District Judge Thomas Deister on Thursday granted an emergency injunction to block plans to cremate the bodies of Tyler and William Jensen, now in the care of a Grand Junction funeral home.

The judge, however, said the boys’ grandparents first must post $5,000.

“The court finds that the preliminary injunction should be issued without notice to respondent (mother Heather Jensen),” Deister wrote in his order.

Attorney Greg Leavitt, who’s representing the boys’ grandmother, Diane Mathena of Clifton, wrote in an application for an emergency injunction that he had attempted unsuccessfully to communicate with Heather Jensen’s attorney, Ed Nugent, about the status of the bodies.

“Because the cremations are arranged and imminent, the court finds that further delay in attempting to reach (Jensen) or (Nugent) should not be required,” the ruling reads.

Deister’s order, however, says the Mathenas must post a $5,000 security bond in order for the injunction to issue, consistent with Colorado legal rules. That had not happened as of early Thursday evening.

“This is why my clients are working to raise money,” Leavitt said.

“... Because (Heather Jensen) is likely to incur attorney fees and costs in response to the actions taken herein, and because Callahan-Edfast Mortuary is likely to incur costs to maintain the boys’ remains until decisions are made in this matter, the court finds that security of $5,000 is necessary,” Deister wrote in the order.

Heather Jensen has asked Callahan-Edfast to cremate the bodies.

Mesa County Chief Deputy Coroner Kim Hollingshead said autopsies were completed for both boys and the bodies were turned over to Callahan-Edfast, consistent with a request from Heather Jensen. Per coroner’s office policy, Hollingshead said remains can be transferred after next-of-kin have been identified, a request has been made for transfer and the coroner’s office has confirmation of a contractual relationship between next-of-kin and a funeral home.

Daryl Pridy, Callahan-Edfast funeral director and assistant manager, confirmed the mortuary has the remains and cremation was “pending but on hold” until the legal issues surrounding the bodies are resolved.

“We want to do what’s best for the boys, as well as the legal representative,” Pridy said.

Aside from the short-term injunction, Diane Mathena is separately requesting that Deister make a final determination of her legal rights to bury her grandchildren, as opposed to the mother. Mathena argues she’s in a much better position to do just that and wants her grandchildren buried next to their father, Eric Jensen, in Palisade.

“The petitioner (Diane Mathena) bases this assertion on the current circumstances surrounding the death of William and Tyler and that those circumstances reflect an uncaring and potential criminal culpable respondent (Heather Jensen),” the filing reads.

Deister noted in his order Heather Jensen would be barred under Colorado law from directing final disposition of the remains if she’s arrested or charged with a felony in connection with the boys’ death. Heather Jensen has not responded to requests for comment from The Daily Sentinel. Nugent has said she’s been advised against making any such statements.

The Mesa County Sheriff’s Department continues to investigate the Nov. 27 incident which started with a 911 phone call from Heather Jensen at 6:31 p.m., who reported she was at Powderhorn Mountain Resort, according to a search warrant affidavit. She told dispatchers her youngest, William, 2, was unconscious, not breathing and had no pulse. He was pronounced dead when authorities arrived.

The affidavit said she reported around 6:50 p.m. that Tyler, 4, was having trouble breathing. Tyler died Monday after being removed from life support.

Two dead children and the grandparents must post bond to prevent their cremation? Insane. The state should have moved to block the cremation, at least until the causes of death are determined.

There is more to their deaths than we now know. Murder charges looking in the future. JMO.

Agreed!! And I also don't understand the Mother's request to have her little dears cremated; unless there is something else she doesn't want found. This is really a tragedy and if innocent of premeditated murder my heart goes out to this young woman who so recently lost her husband - she may have just gone over the edge. Have they interviewed the man in whose truck "parked next to the SUV" she was in? Those poor little guys. tears

Tyler and William were taken from us way too soon. This whole ordeal was preventable. My heart goes out to the grandparents, no one should have to deal with this kind of tragedy. heart As of today Dec. 11 2012 the mother "Heather Jensen" is still on the streets.
