Sioux Falls SD ---- LaVonne Forest watched from her driveway across the street Monday
night as a woman carried her 14-month-old son from the house to the car."I
heard her brother on the cell phone saying he was unconscious," Forest
said. "I thought it was odd. You've got a lifeless baby and (they were)
calm. I'd be freaking out."Deryun Ellys Wilson died
Tuesday night at Avera McKennan Hospital, 25 hours after his parents
brought him in. Doctors had called police soon after the boy was
admitted.
Police spokesman Sam Clemens called the baby's injuries consistent
with child abuse and said the boy was at home when he suffered
life-ending brain damage. Police haven't made any arrests but say the
person they think was responsible was someone the boy knew.At
926 S. Van Eps Ave. Wednesday afternoon, Deryun's two brothers and two
other toddlers played in the backyard while an uncle supervised. The
uncle wouldn't give his name and said Deryun's parents didn't want to
talk, either.Clemens
said police are not concerned about the safety of Deryun's brothers,
who still are in their parents' custody.Neighbors say
several people come and go at the house at various times. It gets
especially busy during summer.Tom Strong said police
officers have shown up often to investigate complaints about a pet
pitbull, car vandalism and theft, and to break up fights and late-night
parties. Firefighters have been called more than once to check on large
backyard bonfires, he said."It's been total chaos since they've been in there,"
Strong said.Robert Huerta, who lives next door, has been
troubled by the way Deryun and his brothers were cared for.The children often
played outside unsupervised at night, he said. Once, a young boy had an
empty bottle of lighter fluid up to his mouth before another child took
it away from him, he said.Huerta was taking out the
recycling last Friday when he saw Deryun screaming as a man held him on
the back porch."It was a cry for help," his wife,
Margarita said.

Doctors at Avera McKennan say 14-month-old Deryun Ellys Wilson had
significant head trauma and brain damage when he was admitted Wednesday
night.
The Minnehaha County Coroner is not releasing the autopsy report but
Sioux Falls Police say they have ruled out accidental death.
The investigation is still on going and police have not made
any arrests but they do have suspects.

"We have a person we're looking at but it's dependent on the
investigation and just because we're looking in that general direction
or maybe at one particular person does not mean that's where we'll end
up," said Officer Sam Clemens.
At this time police think that Deryun was abused by someone
he knew.
We spoke with a social worker at Avera McKennan to see what
hospitals look for when dealing with cases of abuse.
"A lot of what we see is physical indicators that child
abuse has occurred and usually we don't know what's going on in the home
until a child presents," said Social Worker Kari Folkens.
Hospital workers are trained to look for the physical
indicators but to also trust their gut instinct.
"You don't ever want to not act on them, really you want to
error on the side of caution. In looking into it you may offend someone
by inquiring into the cause of a bruise but ultimately you're doing it
in the best interest of a child," said Folkens.
Visitation for Deryun be held at the family residence, 926
S. Van Eps Avenue. Funeral Services will begin at 9:00 am Monday, April
26, 2010 at the residence. Interment will follow Monday afternoon at
Woodlawn Cemetery.

My name is Matthew Wilson the uncle of Deryun Wilson. Im just writing this note to say that the father had nothing to do with any of this. The man that was in the house was the step dad Named Dustin Two Bulls. He was the one who did this to my little nephew!! My brother was fighting for those kids just this last september and they wouldnt give them to him. If they just gave my brother the kids this all could have been prevented. But i lived with the man who killed him and i know how this man acted . I have more info on him and how he was when I lived with him my e mail address is mattbeau_14@hotmail.com please dont put any of this on my brother hes already going throught enough!

Matt, thank you so much for your input. Please forgive me, it's been a long week for me, and maybe I am just not comprehending things as I should....but I'd like to ask you for some clarification. I'm confused.
You are Deryun's uncle, on the paternal side, but you lived with the step-dad? Did I get that right? I'm sorry, I don't mean to be nosy, just trying to put it all together.
Welcome, we will help any way we can, Matt.

Re: DERYUN ELLIS WILSON - 14 months - (2010) Sioux Falls SD
Welcome Matt. I'm sorry for you and your families loss. If you take the time to read our other cases you will see how risky it is to leave young babies and children in the care of a boyfriend or step-parent. You need a lot of patience with children and it is harder for men and harder still if you have no bond with them. Despite that it seems that authorities still favour leaving children with the mother, which I think is wrong if the mother's partner is not of good temperament or character. But that depends on each case and whether the father is an upstanding citizen as well. If it were me I would have taken all the children out of the home just because there were Pitbulls there. There hasn't been much information about who was in the house the time it happened. Do you know where Deryun's mother was when it happened?

Sioux Falls police say they believe the
stepfather of a 14-month-old boy is responsible for the toddler's
death last month.
Police arrested 21-year-old Dustin Two Bulls Monday afternoon in
connection with the April 20 death of Deryun Wilson.
Officer Sam Clemens says all the evidence pointed to Two Bulls
because he was alone with the boy and his brother when Deryun
Wilson was injured on April 19.
An autopsy showed that Wilson died as a result of blunt head
trauma.
Two Bulls remained in jail Monday after a judge set bond at
$250,000 cash.

Re: DERYUN ELLIS WILSON - 14 months - (2010) Sioux Falls SD
We're learning more about the death of 14-month-old Deryun Wilson and
his stepfather, who's charged with murder.
Sioux Falls police arrested Dustin Two Bulls Senior Monday afternoon.
He's charged with second degree murder and first degree manslaughter in
the deadly assault of his wife's toddler son. Tuesday, court papers
reveal more of what the three-week investigation found.

Dustin Two Bulls Senior was left to take care of 14-month-old Deryun
Wilson and his two-year-old brother. Instead, police say the 21-year-old
caused injuries so severe to the young child, he died the following day
at Avera McKennan Hospital.
New court documents say on April 19, 2010 the child's mother says Deryun
was fine when she left home. She told police she had been running
errands for 45 minutes when Two Bulls sent her a text message reading,
"Treyton pushed Deryun and I think he gave him too much water. I don't
know what happened."
When she got home, Two Bulls told her she did not have to call 911. But
when she picked up the child, he went limp in her arms so she took him
to the emergency room.
That's where doctors found the child was bleeding from the brain, and
his brain was swelling. They also found bruises all over his body,
including near his ear, chest, abdomen, both thighs, bottom and lower
back.
That day was the first time police first interviewed Two Bulls. He told
detectives he was busy folding clothes when he noticed Deryun was
crawling down the back porch steps backwards. Then Two Bulls heard a
thumping sound and found Deryun at the bottom of the steps. He told
detectives the two-year-old brother may have pushed him down those
steps.
Detectives say those steps were just 34.5 inches tall, which a doctor
says, during a fall would only cause some bruises, not the kind of brain
injury Deryun had when he arrived at the hospital.
Doctors took Deryun off life support the next day.
In court Tuesday afternoon, an attorney for Two Bulls didn't ask for a
lesser bond, so he remains in jail held on a quarter million dollars
cash only bond, facing life in prison if he's convicted of either
charge.

This paternal blood family needs custody of these other 2 boys before any more happens... How do they get help from the legal world. They are running into roadblocks as did the father last summer before Deryun was killed! Any suggestions?

My suggestion to you is to not stop seeking help. There are agencies out there that can help you. You can try looking for any legal aid agencies that will work with you. Because there is a history already of one murdered child, I would think that an agency will take the other child away from this mother because she put these children in jeopardy. IMO she should be arrested too because she should have seen signs of abuse. I think that you can see signs when children are abused. This is not just a one time thing. Tell family to document every little thing and make sure that the child is seen by other family members at all times until the courts decide what they will do with the other child. I hope this helps. Im sorry for your loss. Families also need to be more vigilante about their nieces and nephews (of course if they live close by)....

Re: DERYUN ELLIS WILSON - 14 months - (2010) Sioux Falls SD
The county where the children reside should be contacted - they should have legal aid services, and child abuse can be reported and they can help you with the appropriate contacts. these other children need a guardian ad litem (or whatever your state provides) appointed for them. Call the local police and lodge a formal complaint about the mother and abuse. Call the newspaper - email the reporter covering the story. Do everything you can to raise awareness of this - that other children are in danger as well.

Deryun
hi this is Matt again sorry it took so long for a reply. I just wanted to reply to what you have asked. i lived with dustin for just a little while but enough to know that something was seriously wrong with him. He would call my brother while he was at work and threaten to come to his job with guns and even Deryuns mom would be behind him egging him on. Dustin didn't like me or my sister because we were my brothers siblings. while i was living there he wouldn't even watch the kids because he didnt like to change their dipers and he just slept the whole time. Im taking up for the pitbulls because they were well trained and would never hurt my nephews. One of our dogs was a house dog also and the only reason why he was called in was because he was a hyper dog. But dustin was a marine for a little while and he would talk about how he would kill people over there and he would say it like there wasnt anything wrong with it. The mom and Dustin would drink every night and the mom was on pills and she would tell us she was having suicidal thoughts every time she drank. they married after knowing eachother for only about 3 months. I loved my nephew and he was going to be my god son and i never thought something like this would happen. if you need to know more just e mail me at mattbeau_14@hotmail.com

Man held in child's death faces rape charge in separate case
11:00 PM, Apr. 6, 2011
A Sioux Falls man charged with manslaughter in the beating death of his 14-month-old stepson last year has been charged with fourth-degree rape in an incident that occurred three years ago.
Dustin Samuel Two Bulls Sr., 22, pleaded not guilty Wednesday to one count of fourth-degree rape.
Prosecutors say Two Bulls had sex with a 15-year-old victim in December 2007 or January 2008.
The case began in 2008, police spokesman Sam Clemens said, when the 15-year-old's pregnancy was reported to the Department of Social Services.
The case was dropped because she did not want to cooperate with investigators, Clemens said.
It was reopened about one year ago when the girl, now 18, visited Two Bulls at the Minnehaha County Jail and discussed the baby. Detectives reviewed the video of the visit, then took a blood sample from Two Bulls and used it to prove paternity.
A grand jury indicted him on the rape charge last week.
Two Bulls' lawyers have been battling for months to suppress incriminating statements he made to police after the death of his stepson, Deryun Wilson, the son of a different woman whom he married. Two Bulls faces first-degree manslaughter charges in the case and has been held at the Minnehaha County Jail since the child's death last May.
The penalty for fourth-degree rape is 15 years in the state penitentiary. The manslaughter charge is punishable by as much as life in prison without parole.

Re: DERYUN ELLIS WILSON - 14 months - (2010) Sioux Falls SD
A man accused of killing his 14-month-old stepson will not stand
trial for murder or manslaughter charges after a judge's ruling this
week that questioned the science behind the accusations.Dustin
Samuel Two Bulls, Sr., 22, has been in jail awaiting trial on
second-degree murder and first-degree manslaughter charges since Deryun
Wilson was rushed to Avera McKennan Hospital one year ago with brain
hemorrhages that eventually took his life. Two Bulls still
faces as much as 15 years in prison on an unrelated fourth-degree rape
charge, but it now is unlikely that anyone will stand trial for the
child's death."This is still a homicide," Deputy State's Attorney Randy Sample said. "I just can't prove who did it."Two
Bulls' lawyers did not return calls for comment Monday. In a series of
motions hearings in February and March, however, they called experts to
question the validity of the prosecution's version of events, which was
premised on the notion that the baby died of abusive head trauma,
sometimes referred to as shaken baby syndrome, at the hands of Two
Bulls.Experts from both sides disagreed on whether shaking alone could result in the type of injuries that caused Wilson's death.Minnehaha
County Coroner Kenneth Snell testified that a shaking death was
possible, but he said there is "no way to tell" how long a child with a
head injury still could be mobile. He cited the case of a child who
appeared lucid after a fall from monkey bars but later died.Dr.
Janice Ophoven, an expert hired by the defense, testified that
investigators should look back over the previous three days when
attempting to pinpoint the underlying injury behind a death from abusive
head trauma. She claimed that shaken baby syndrome is a scientifically
unsound diagnosis.Two
Bulls was alone with Wilson for only about 20 minutes in the days
leading up to the child's death May 20, Sample said, and several other
people had contact with the child for short periods of time. Two Bulls told Wilson's mother that the child had fallen down some steps when she came home May 19 to discover the injuries.
"We only had a very short window of time in which this individual had the child," Sample said.In
his decision about the scientific testimony, Judge Joseph Neiles wrote
that the science alone cannot prove Wilson was murdered."Dr.
Snell's testimony was that he would not diagnose (shaken baby syndrome)
unless there was either a witness to the act or a confession to the
act, in addition to the physical findings," Neiles wrote.Complicating
matters further was the judge's finding Monday that Two Bulls had asked
for and been denied a lawyer during an interview after his arrest. That
decision threw out incriminating statements he had made to detectives. Two Bulls still might spend time in prison, however. He
faces a fourth-degree rape charge stemming from a sexual encounter with
a 15-year-old girl that took place before his marriage to Wilson's
mother.A grand jury indicted him on the rape charges in
early April after a paternity test proved that Two Bulls fathered a
child with the girl, now 18. A trial on that matter is scheduled for
July."I would say our case is very strong there," Sample said.
