Investigators say they've charged a 12-year-old boy's sister and her
boyfriend with murder in the death of the child. Investigators
were called to the Camelot Condominiums off of Old National Highway on
Thursday after getting a 911 call about a boy who was said to be
suffering from heat stroke. But police say the child was being punished
by his sister, Sabrina Powell, and her boyfriend, Omar Pitts. Powell
and Pitts explained that the boy was told to stand outside and hold a paint
bucket, and they claim the child passed out and did not regain
consciousness. The boy was rushed to the hospital, where he later
died. The Fulton County Medical Examiner’s office says the 12-year-old
boy did not die of natural causes. The official cause of death has not
been released.

Police said Friday morning that both Powell
and Pitts were charged with felony murder and cruelty to children.
Both of them waived their first appearance hearing on the charges.

Investigators found paint stains in the grass behind the family's apartment, and a
paint can sitting on the back deck of the family's apartment.

DA seeks death for trio in boy's slaying

Prosecutors say they will seek the death penalty for an Atlanta woman, her boyfriend and a third suspect charged in the June slaying of the woman's 12-year-old brother.

The trio will be arraigned next Monday in Fulton County Superior Court.

Twelve-year-old Jaytavious Mahone died June 17 after his sister, Sabrina Powell, and her boyfriend, Omar Pitts, forced him to stand outdoors in 90-degree heat holding a bucket of paint, police said.

Powell, 29, and Pitts, 27, initially told officers they were punishing the boy when he suffered a heat stroke. However, a neighbor at the Camelot apartment complex on Old National Highway videotaped Pitts kicking the boy repeatedly in the head shortly before he collapsed. The boy "did not regain consciousness," Fulton police spokeswoman Kay Lester said, and died shortly after at South Fulton Medical Center.

Powell and Pitts are charged with her brother's murder and child cruelty. A third suspect, Noel Dale, was later implicated in Jaytavious' death.

Hakim Deen, who videotaped the assault from an upstairs window, said the youth was kicked "eight or nine times."

"The boy got up and then passed out," Deen told the AJC in June.

ATLANTA, Ga. - Three people accused of beating a 12-year-old Fulton County boy to death last summer will stand trial in early 2011. One of the defendants was in court on Monday to face charges in the death of Jaytavious Mahone.

Police say the three suspects forced Jaytavious to stand outside in 90-degree temperatures holding a paint can. Then, police say, they kicked the boy in the head repeatedly after he collapsed.

The incident happened in June, and the medical examiner ruled that the boy died of blunt force trauma. A neighbor recorded a portion of the violent assault with his cell phone camera.

Omar Pitts, Sabrina Powell and Noel Dale are accused of murdering the boy. Pitts was arraigned on murder charges in a Fulton County courtroom on Monday, nearly six months after the boy was killed.

Powell, who is the boy’s sister, and Dale did not appear in court Monday, after their attorneys told the judge they were waiving formal arraignment. Attorneys for all three suspects asked that they be tried separately.

Pitts faces a possible death sentence if he is convicted.
