The man accused of beating his girlfriend's 4-year-old son to death because he soiled himself has been ordered held without bail.Police say Jorge Busso, 23, allegedly beat the boy with a belt Friday as punishment for soiling himself.During a videotaped appearance before an unidentified Maricopa County Superior Court commissioner, a prosecutor recommended that no bond be allowed on the felony child abuse charges because Busso is in the country illegally, which makes him a flight risk.Busso then spoke up and said he plans on marrying his girlfriend and having a child to get his immigration status cleared up."I have her already talking to a lawyer to see if he can get us married as soon as possible to get that taken care of," Busso told the commissioner. The commissioner cautioned Busso not to make any incriminating statements and said he would have to take the issue up with a court-appointed lawyer. The beating occurred this past Friday, and the boy died Sunday. Busso was arrested Monday and made his initial appearance later in the day.The hearing apparently occurred before court officials knew the child had died. Busso appeared shocked when a prosecutor told the court that it appeared the boy would not live.Mesa police said the charges against Busso would likely be upgraded to homicide.Meanwhile Tuesday, police said Busso's girlfriend had not been charged in the case.Initial police reports stated that she originally told police the boy had been with a baby sitter and hit his head.Police said the boy and his 6-year-old brother were left in Busso's care while she went to work.Busso reportedly drove the mother and 6-year-old to work and school while the 4-year-old waited at home in the 200 block of South 89th Street.According to the police report, Busso smelled a foul odor coming from the 4-year-old's room. When he realized the smell was from the boy soiling his pants, Busso yelled at the boy and said he was "very upset," police said.Busso had the boy stand alone in a corner of his room for a short period of time before returning and cleaning the boy in the shower.Police said Busso then told the boy he would be punished and placed him against a sharp corner.Busso reportedly told police that he initially spanked the clothed boy's buttocks with his hand.Officers said Busso told them that next he used a belt to hit the boy on his forearms, back, buttocks and face.Busso told police the boy would not sit still, so he pushed him against the corner, which was reinforced with two-by-fours, the report said.Busso reportedly told the boy to stand in the corner and then left the room for 30 minutes, police said.He returned to the boy's bedroom after hearing a thump, officers said.Busso discovered the thump was the sound of the boy hitting the ground. He was lying on the floor "unresponsive and limp," the report said.Police said Busso placed the motionless boy in his bed.Approximately an hour and a half later, Busso picked up the boy's brother and mother, police saidThe boy's mother went to check on him and found him in bed.He was unresponsive with purple and white fingers and toes and red bruises and marks on his forehead and face, officers said. She immediately took the boy to Banner Baywood Medical Center, police said. From there, he was airlifted to Phoenix Children's Hospital. The hospital contacted authorities citing the boy's "massive head trauma" and bruising on his body, the report states.

Grrrrrr, I'd like to see her face charges of some sort. How about for being so stupid! Sounds like she's still standing by her man and would marry him and have another baby. That ought to be a FF crime

Jorge Alberto Busso Jr. Indicted for First Degree Murder, Felony Child Abuse

PHOENIX, AZ (December 13, 2010) – Jorge Alberto Busso Jr. (DOB 6/1/1987) has been charged with first degree murder and three counts of felony child abuse in connection with the death of four year-old Ramon Alejandro Haro Colin. Busso, who is in the country illegally, is currently being held without bail. Colin is the son of Busso’s girlfriend.
"Adults who harm children must be held accountable for their actions, especially when those actions result in the death of an innocent child," said Maricopa County Attorney Bill Montgomery. "The degree to which any society can be judged civilized is, in part, to the degree that we protect and defend the most innocent and defenseless among us. We will vigorously prosecute this case to the fullest possible extent to ensure that justice is done," Montgomery added.
According to a report by Mesa Police, Busso discovered that Colin had soiled himself while the child was left alone in his care. Busso told police that he struck Colin and that the child’s head hit a wall. Colin was taken to a hospital where he later died from his injuries.
The first degree murder charge stems from Busso allegedly causing Colin’s death in the course of committing or attempting to commit child abuse. The three child abuse counts consist of a class 2 felony count for causing a head injury to Colin, a class 4 felony count for causing bruises on the Colin’s body, and a class 2 felony count for failing to seek medical care for the child. A physician who attended to Colin claims the child may have survived his injuries had he received medical attention earlier.
